14. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Subject to the optional provision below, you agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Rockland County, New York, and you consent to personal jurisdiction there.

OPTIONAL — REVIEW WITH COUNSEL BEFORE INCLUDING (informal resolution; arbitration; class-action waiver): Before filing any claim, you agree to first contact us at andy@homesolarandy.com and attempt to resolve the dispute informally for at least 30 days. If unresolved, any dispute will be resolved by binding individual arbitration rather than in court, except that either party may bring a claim in small-claims court. You and Homes Andy Solar waive the right to a jury trial and to participate in a class action. (Arbitration and class-waiver clauses must be carefully drafted and conspicuously presented to be enforceable; do not include this paragraph without attorney review.)

15. CHANGES TO THESE TERMS

We may modify these Terms at any time. When we do, we will revise the “Last Updated” date and post the updated Terms on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

16. SEVERABILITY

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any separate written agreement you enter into with us, constitute the entire agreement between you and Homes Andy Solar regarding the Site and supersede any prior agreements on that subject.
